Welcome to Bitwell Tech! These Terms and Conditions ("Terms") govern your use of our website, wristband, and related Apps and services. By accessing or using our services, you agree to abide by these Terms.

1. Acceptance of Terms

By using the Bitwell Band website, apps, or device, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue using our services.

2. Eligibility

To use Bitwell Tech services, you must:

  • Be at least 18 years old or have the consent of a parent or guardian if under 18.
  • Provide accurate and up-to-date personal information.
  • Agree to use our services solely for personal health monitoring and emergency alert purposes.

3. Health Disclaimer

The Bitwell Band is not a medical device. It is designed for health tracking and emergency notifications but should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a healthcare provider for medical concerns.

4. User Responsibilities

  • You are responsible for the accuracy of the personal and health information you provide.
  • You agree to keep your account details, including login credentials, secure and confidential.
  • You are responsible for any activity conducted through your account, and Bitwell Tech will not be held liable for unauthorized access or use.

5. License and Restrictions

Bitwell Tech grants you a limited, non-exclusive, non-transferable license to use our services for personal, non-commercial purposes.

Prohibited Activities:

  • You may not modify, reverse-engineer, or attempt to gain unauthorized access to any part of our services or software.
  • You may not misuse our services for unlawful activities or distribute malicious software.
  • You may not use Bitwell Tech's services for any form of advertising or commercial purposes.

6. Intellectual Property

All content on our website, including text, graphics, logos, software, and trademarks, is the property of Bitwell Tech or its licensors. You may not copy, modify, or distribute any content without prior written permission.

7. Limitation of Liability

Bitwell Tech and its affiliates, partners, and employees shall not be held liable for:

  • Any direct, indirect, incidental, or consequential damages arising from your use or inability to use the product.
  • Any harm, injury, or health issues resulting from reliance on the data or alerts provided by the Bitwell Tech services and Apps.
  • Any loss or unauthorized access to personal data due to security breaches beyond our control.

7a. Purchase and Payment Terms

Pre-Order Terms:

  • The pre-order booking amount of ₹499 is adjustable against the final product price of ₹5,999.
  • Pre-orders are limited to 100 units and secure your priority access to the BitwellBand.
  • The remaining balance (₹5,500 + applicable shipping charges) will be collected before the product is shipped.
  • Shipping is expected to begin by the end of December 2025.
  • If you do not complete the remaining payment when requested, 80% of your pre-order amount (₹399.20) will be refunded within 5 working days.

Full Purchase Terms:

  • The BitwellBand hardware costs ₹5,999 (one-time payment) plus applicable shipping charges.
  • Shipping charges will be communicated before finalizing your order.
  • All prices are in Indian Rupees (INR) and include applicable taxes unless otherwise stated.

Payment Processing:

  • All payments are processed securely through Razorpay, our authorized payment gateway partner.
  • We do not store your credit card, debit card, or banking information.
  • You are responsible for ensuring that your payment information is accurate and up-to-date.
  • Payment confirmation will be sent to your registered email address.

Non-Transferability:

  • Pre-orders and purchases are non-transferable to another person.
  • However, you may provide a different delivery address and recipient name at the time of shipping.

7b. Subscription Services

The BitwellBand requires a monthly subscription of ₹199/month for full functionality and monitoring services. Subscription payments are managed through Google Play Store in-app purchases and are governed by Google Play's terms and policies. Bitwell Tech does not process or store subscription payment information.

8. Warranties and Disclaimers

Services Provided "As-Is": Bitwell Tech provides its services on an "as-is" and "as-available" basis, without any warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or availability of the data, services, or alerts provided by the Bitwell Tech.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Third-Party Services

Our services may link to or integrate with third-party platforms or services. We are not responsible for the practices or content of these third parties, and your use of such services is subject to their respective terms.

10. Termination of Service

We reserve the right to suspend, restrict, or terminate your access to our services at any time for any reason, including but not limited to violation of these Terms or engaging in prohibited activities.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bitwell Tech and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Modifications to Terms

We reserve the right to update or modify these Terms at any time. If we make significant changes, we will notify users by posting the updated Terms on our website. Continued use of the services after changes are made constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, and any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bhopal, Madhya Pradesh.

14. Force Majeure

Bitwell Tech is not liable for any failure or delay in providing services due to causes beyond our reasonable control, including but not limited to natural disasters, power failures, internet outages, or governmental actions.

15. Community Participation

By participating in the Community section, you agree to abide by the Community Rules. Content shared, such as questions or comments, may be moderated to ensure quality and relevance. Bitwell Band reserves the right to anonymize and share content with verified professionals for providing accurate and reliable responses while maintaining user privacy.
